1. Acceptance of Terms

By accessing or using the Skincoach platform, including our website, mobile applications, and related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and Skincoach ("we," "our," or "us").

2. Service Description

Skincoach is a technology platform that connects patients with licensed skincare practitioners, including dermatologists and aestheticians. Our services include practitioner discovery, appointment booking, secure messaging, skin assessments, treatment plan management, and payment processing. Skincoach acts as an intermediary between patients and practitioners and does not itself provide medical or skincare services.

3. User Accounts

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate, complete, and current information during registration.
• Maintain the security and confidentiality of your login credentials.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

You must be at least 18 years old to create an account. Practitioner accounts are subject to verification of professional credentials.

4. Health Information Disclaimer

The Platform is not a substitute for professional medical advice, diagnosis, or treatment. Skin assessments, practitioner recommendations, and treatment plans provided through the Platform are for informational and scheduling purposes only. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of information obtained through the Platform. If you experience a medical emergency, contact emergency services immediately.

5. Bookings and Payments

• Appointment bookings are subject to practitioner availability and confirmation.
• Payments are processed securely through Square. By making a payment, you agree to Square's terms of service.
• Cancellation and refund policies are set by individual practitioners. Please review the practitioner's cancellation policy before booking.
• Skincoach may charge service fees for bookings made through the Platform.

6. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Impersonate any person or entity, or misrepresent your affiliation.
• Interfere with or disrupt the Platform, servers, or networks connected to the Platform.
• Attempt to gain unauthorized access to any part of the Platform or other users' accounts.
• Use automated tools (bots, scrapers, etc.) to access or collect data from the Platform without our written permission.
• Post or transmit harmful, threatening, abusive, defamatory, or otherwise objectionable content through the messaging features.
• Use the Platform to send unsolicited communications or spam.

7. Intellectual Property

All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, icons, images, software, and the overall design — are the exclusive property of Skincoach or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.

8. User Content

By submitting content to the Platform (including messages, reviews, and profile information), you grant Skincoach a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content solely for the purpose of operating and improving the Platform. You retain ownership of your content and may request its deletion in accordance with our Privacy Policy.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Skincoach and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid to Skincoach in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure. We do not endorse or guarantee the qualifications, competence, or quality of services provided by any practitioner on the Platform.

11. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately, but provisions that by their nature should survive (including limitations of liability, intellectual property rights, and dispute resolution) will remain in effect.

12. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to the practices described in the Privacy Policy.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Skincoach operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
